These Terms of Engagement govern your use of the La Pointe Creative website and describe general terms relating to inquiries and consulting engagements.
Visiting this website or submitting an inquiry does not, by itself, create a client, consulting, fiduciary, partnership, employment, or other professional relationship with La Pointe Creative.
Any consulting engagement will be governed by a separate written proposal, statement of work, agreement, or other written terms accepted by La Pointe Creative and the client.

About La Pointe Creative
La Pointe Creative is a founder-led consulting practice based in Santa Monica, California.
La Pointe Creative helps businesses identify operational friction, improve workflows and customer experiences, evaluate technology, and design or implement practical systems and solutions.
The specific scope of any consulting engagement is determined separately with each client.

Website Information
The information provided on this website is for general informational and marketing purposes.
Nothing on this website constitutes legal, financial, accounting, tax, medical, employment, cybersecurity, or other regulated professional advice.
Business examples, descriptions, frameworks, diagrams, and other website content are illustrative and may not apply to every organization or situation.
[ 03 ]
Inquiries
Submitting an inquiry through this website does not obligate you to hire La Pointe Creative and does not obligate La Pointe Creative to accept an engagement.
La Pointe Creative may review information submitted through an inquiry to determine whether a potential project appears appropriate for further discussion.
Do not submit confidential, proprietary, financial, health, trade-secret, or other sensitive information through the general inquiry form.
A confidential client relationship should not be assumed unless and until appropriate written terms have been agreed upon.
[ 04 ]
Consulting Engagements
Before substantive consulting work begins, the parties may agree to separate written terms describing matters such as:
- Scope of work
- Deliverables
- Responsibilities
- Fees and payment schedule
- Project timing
- Revisions or change requests
- Intellectual property rights
- Confidentiality
- Termination
- Other project-specific terms
If these Terms of Engagement conflict with a separately executed client agreement concerning consulting services, the executed client agreement will control with respect to that engagement.
[ 05 ]
Fees and Payment
Fees, deposits, payment schedules, expenses, cancellation terms, and other financial arrangements for consulting services will be specified in the applicable proposal, statement of work, invoice, or client agreement.
No pricing displayed or discussed generally on this website should be interpreted as a binding offer unless expressly identified as such in writing by La Pointe Creative.
[ 06 ]
Client Responsibilities
Successful consulting work depends on timely access to accurate information, appropriate stakeholders, feedback, decisions, systems, and other resources relevant to the engagement.
Clients are responsible for the accuracy and completeness of information they provide and for reviewing and approving recommendations, designs, workflows, configurations, or deliverables before implementation when applicable.
Clients remain responsible for their own business decisions and operations.
[ 07 ]
Third-Party Services and Technology
La Pointe Creative may recommend, configure, integrate, or assist clients with third-party software, artificial intelligence tools, platforms, APIs, automation services, hosting providers, or other technologies.
Unless expressly stated otherwise in a written client agreement, these third-party services are provided and controlled by their respective providers, not La Pointe Creative.
La Pointe Creative does not control and cannot guarantee the availability, security, accuracy, pricing, functionality, policies, continued operation, or future changes of third-party services.
Clients are responsible for reviewing and complying with applicable third-party terms, licenses, privacy policies, and usage requirements.
[ 08 ]
Artificial Intelligence
Certain consulting workflows or solutions may involve artificial intelligence or machine-assisted technologies where appropriate.
AI-generated or AI-assisted outputs may contain errors, omissions, inaccuracies, or unexpected results and should not be assumed to be accurate solely because they were produced by an automated system.
The appropriate use of AI depends on the specific project, information involved, applicable laws, contractual obligations, and business context.
Project-specific use of artificial intelligence involving client information or systems may be addressed in the applicable client agreement when appropriate.
[ 09 ]
Results
La Pointe Creative works to provide thoughtful, practical recommendations and solutions based on the information available during an engagement.
Business outcomes depend on numerous factors outside La Pointe Creative's control.
Unless expressly stated in a written client agreement, La Pointe Creative does not guarantee specific financial results, revenue increases, cost reductions, efficiency improvements, customer outcomes, technology performance, or other business results.
[ 10 ]
Intellectual Property
Unless otherwise stated in a written client agreement, the La Pointe Creative website, brand, original written content, methodologies, frameworks, graphics, and other materials created for general use remain the property of La Pointe Creative or their respective rights holders and are protected by applicable intellectual property laws.
Ownership and permitted use of project-specific deliverables will be governed by the applicable client agreement.
